These Terms of Service (“Terms”) govern your access to and use of Ecomity, including the Ecomity Academy, League, tools, dashboards, educational materials, AI-assisted features, templates, calculators, business planning tools and related digital services (collectively, the “Service”).

By purchasing a membership, creating an account, accessing the Service, or otherwise using Ecomity, you agree to these Terms.

1. About Ecomity

Ecomity is a digital education and ecommerce operating platform designed to help users learn, plan, build and operate ecommerce businesses.

Ecomity provides educational information, software tools, templates, calculators, planning systems and AI-assisted functionality. Ecomity does not operate your business for you and does not make business, legal, accounting, tax or financial decisions on your behalf.

2. Eligibility

You must be at least 18 years old, or have reached the age of legal majority in your country of residence, to purchase or use the Service.

By using Ecomity, you confirm that the information you provide is accurate and that you are legally capable of entering into a binding agreement.

3. Membership Plans

Ecomity currently offers paid membership plans, including CORE and PRO.

The features included in each plan are described on the Ecomity website at the time of purchase. Features may be improved, replaced or reorganized over time, provided that the essential nature of the purchased Service is not materially reduced during an active paid period, except where necessary for security, legal compliance or technical reasons.

4. Subscription Billing and Automatic Renewal

Ecomity memberships are recurring subscriptions unless otherwise stated at checkout.

By purchasing a recurring membership, you authorize us and our payment providers to charge the applicable membership fee automatically at each billing interval until the subscription is cancelled.

The applicable price and billing frequency are displayed before checkout.

You are responsible for keeping your payment information valid and up to date.

5. Cancellation

You may cancel your subscription at any time through the available account or subscription management options, or by contacting support.

Cancellation stops future renewals. Unless otherwise required by applicable law, cancellation does not automatically provide a refund for a billing period that has already started.

Your access may remain active until the end of the paid billing period.

6. Consumer Withdrawal Rights

If you are a consumer located in the European Union, European Economic Area, United Kingdom, or another jurisdiction that provides mandatory withdrawal or cancellation rights, those statutory rights continue to apply.

Where applicable law requires a right of withdrawal, Ecomity will honor that right in accordance with applicable consumer protection law.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or waived.

7. Digital Service and Immediate Access

Ecomity is primarily a digital service that may become available immediately after purchase.

Where applicable law requires your express consent before digital content or digital services are supplied during a statutory withdrawal period, such consent will be requested where legally required.

8. No Guaranteed Business Results

Ecomity does not guarantee revenue, profit, sales, business growth, advertising performance, customer acquisition, investment returns or any other financial or commercial result.

Any examples, projections, case studies, calculations, benchmarks, simulations or potential outcomes shown within Ecomity are provided for educational and informational purposes only.

Your results depend on factors including your product, market, pricing, execution, advertising, costs, competition, experience and business decisions.

You remain solely responsible for your business activities and decisions.

9. Educational Information Only

Nothing provided through Ecomity constitutes legal, accounting, tax, investment, financial or other regulated professional advice.

Calculators and tools may provide estimates based on information entered by the user. These results should be independently verified where important business decisions depend on them.

You should seek advice from a qualified professional where appropriate.

10. AI-Assisted Features

Some parts of Ecomity may use artificial intelligence or automated systems to generate explanations, suggestions, summaries or recommendations.

AI-generated content may be incomplete, inaccurate or unsuitable for your specific circumstances.

You are responsible for reviewing and verifying AI-generated information before relying on it.

11. Account Security and Personal Use

Your membership is personal to you unless Ecomity expressly provides a multi-user or business account.

You must not:

  • share or resell your account credentials;
  • provide unauthorized third parties with access to paid Ecomity content;
  • copy, redistribute, publish or commercially resell Ecomity materials without written permission;
  • attempt to bypass membership restrictions, security controls or usage limits;
  • misuse the Service in a way that interferes with other users or the platform.

You are responsible for maintaining the confidentiality of your login credentials.

12. Intellectual Property

Unless otherwise stated, the Ecomity platform, design, branding, software, educational materials, templates, text, graphics, workflows and original content are owned by or licensed to Ecomity and are protected by applicable intellectual property laws.

Your membership gives you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purpose.

No ownership rights are transferred to you.

13. User Data and Business Information

Certain Ecomity features may allow you to store business information, calculations, notes, decisions and other data.

You remain responsible for the accuracy and legality of information you submit.

Personal data is handled in accordance with our Privacy Policy.

14. Third-Party Services

Ecomity may integrate with or link to third-party platforms or services, including payment providers, ecommerce platforms, AI providers or other software.

We are not responsible for the independent operation, availability, security, pricing or policies of third-party services.

Your use of third-party services may also be subject to their own terms.

15. Availability and Changes to the Service

We aim to keep Ecomity available and reliable, but uninterrupted or error-free operation cannot be guaranteed.

The Service may occasionally be unavailable due to maintenance, updates, technical failures, third-party outages or circumstances outside our reasonable control.

We may update, improve, replace or discontinue individual features where reasonably necessary for technical, security, legal or product-development reasons.

16. Suspension or Termination

We may suspend or terminate access where a user materially breaches these Terms, engages in fraud, abuses the Service, attempts unauthorized access, shares paid access unlawfully, or uses the Service in a way that creates legal, security or operational risk.

Where reasonably possible and legally required, we will provide appropriate notice.

17. Refunds

Refund eligibility is governed by our Refund Policy and applicable law.

Nothing in these Terms excludes a refund or remedy that must be provided under mandatory consumer law.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Ecomity will not be liable for indirect, incidental, consequential or special losses, including loss of profit, revenue, business opportunity, data or anticipated savings arising from the use of or inability to use the Service.

Ecomity is not responsible for losses caused by business decisions made using educational material, estimates, calculators, AI-generated outputs or other information available through the Service.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses or liabilities arising from your unlawful use of the Service, your violation of these Terms, or your infringement of third-party rights.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, applicable law or business operations.

The latest version will be published on our website together with the date of the latest update.

Material changes affecting an active subscription will be communicated where required by law.

21. Governing Law

These Terms are governed by the laws applicable to the operator of Ecomity, subject to any mandatory consumer protection rights that apply in the country where the customer resides.

If you are a consumer, nothing in this section removes rights granted to you by mandatory consumer law.
